What's "Right" about Rights?

Tutorial- Fall Semester/2000 Russell K. Osgood Jonathan Brand

The purpose of this tutorial is to explore what we can learn about the scope of legal "rights" by reading U.S. Supreme Court opinions. We will specifically focus on tensions that exist between the protection of individual or group rights on the one hand and the furtherance of the common good and the public welfare on the other hand. The materials for this course have been chosen to provide students with an opportunity to explore what is good or "right" about rights in the law by developing their skills in critical reading, analysis, writing, and oral expression. This is one of a pair of tutorials on the topic of rights; this tutorial will focus on law in the context of an overall governmental system. On occasion, the tutorials will have joint meetings.
